What do scholars say about the matter that someone gifts something edible to his brother on the condition that he will not pass it on, is this condition valid? And can it be given to someone else or not?

Answer #: 225

                             In the Name of Allah, the Most Gracious, the Most Merciful.

                                As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

This gift is valid, but the mentioned condition is not, hence if the recipient wishes to give it to someone, he can.

"قال اصحابنا جمیعا: اذا وھب ھبۃ وشرط فیھا شرطا فاسدا، فالھبۃ جائزۃ، والشرط باطل کمن وھب لرجل امۃ فاشترط علیہ ان لا یبیعھا۔۔۔۔ فالھبۃجائزۃ،وھذہ الشروط کلھا باطلۃ،کذا فی السراج الوھاج۔"                                     (الھندیۃ: 4/396)

"(و) حکمھا(انھا لاتبطل بالشروط الفاسدۃ)۔"   (الدر مع الرد: 5/688)
